  • With the expungement of an arrest or conviction, you can honestly answer "NO" to a question about the crime or arrest that was expunged.
  • Not all convictions can be expunged, and in those states that allow the expungement of convictions, the severity of the crime, the number of previous convictions and the amount of time since release can all be factors affecting whether a conviction may be expunged.
  • An arrest record should be expunged even if you were acquitted, charges were dropped, you completed a first-offender program or you pled guilty to a lesser crime (such as ARD, PTI, Section 17, etc.). A record of your arrest remains even if you are not convicted, unless a separate proceeding is undertaken.
